Terms of Service

The service

EchoTaplets you record short audio, video, and photo “echos,” group them with the people you choose, and share them via NFC charms or QR-coded greeting cards. The Service includes the website at echotap.io and any associated chips, codes, or printed materials.

Your account

You need an account to record echos, claim charms, and create groups. You’re responsible for the activity that happens under your account. Keep your sign-in email secure; if you suspect unauthorized access, sign out and contact us.

You must be at least 13 years old to use EchoTap. If you’re creating an account on behalf of an organization, you confirm you have authority to bind that organization to these Terms.

Acceptable use

EchoTap is for personal, non-commercial sharing between people who know each other. You agree not to:

• Post or share content you don’t have the right to share, including content that infringes copyright, trademark, or other rights.
• Record or share content of people who haven’t consented to be recorded or to have their likeness shared with the group.
• Use the Service to harass, threaten, defame, or impersonate anyone.
• Attempt to gain unauthorized access to other accounts, groups, or charms.
• Use the Service for unlawful purposes, including the transmission of spam, malware, or phishing content.
• Resell, sublicense, or commercially exploit the Service without our written permission.

We may remove content or suspend accounts that violate these rules.

Your content

You retain ownership of the echos and other content you upload. By uploading, you grant EchoTapa limited, non-exclusive, royalty-free license to host, store, transcode, and display that content for the sole purpose of operating the Service for you and the people you share with. We don’t use your content to train AI models or for any other purpose outside delivering the Service.

You can delete individual echos and entire groups from inside the app. Deleted content is removed from active Service surfaces immediately and from backups within 30 days.

SMS notifications

Sign-in security codes. EchoTap signs you in with a one-time code texted to your phone by our login provider. This is standard account authentication that you trigger by signing in. It is not a marketing or notification subscription.

New-greeting alerts (optional). You may separately choose to receive a text when someone adds a greeting to a card or group you belong to. These alerts are off by default and are never required to create an account, make a purchase, or use any EchoTap feature. You turn them on (and off) at Account → Notifications. Message frequency varies; message and data rates may apply. Reply STOP to opt out at any time, or HELP for assistance.

EchoTap does not send third-party offers, affiliate marketing, or promotional content from other companies via SMS. All messages are transactional and relate to your EchoTap account.

Charms and greeting cards

When you purchase a EchoTap charm or greeting card, you receive a physical chip or printed code that links to EchoTap. The chip itself is yours; the right to use the linked Service is governed by these Terms. Chips can be re-claimed and reset; the most recent claim controls the connected group until disconnected or re-claimed.

Privacy

Your use of EchoTap is also governed by our Privacy Policy, which explains what information we collect and how we use it.

Disclaimers

EchoTapis provided “as is” without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free from data loss. To the fullest extent permitted by law, SearchBrook LLC disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, SearchBrook LLC and its affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid to us for the Service in the 12 months before the claim arose, or (b) US$50.

Termination

You can stop using EchoTap and delete your account at any time from /account. We may suspend or terminate your access if you violate these Terms or use the Service in a way that creates risk for us or other users.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date at the top of this page; significant changes will also be communicated in the app. Continued use of the Service after changes constitutes acceptance.

Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Los Angeles County, California.
